Consent to receive newsletters and information on the processing of personal data

Purpose and Subscription

The Newsletter is a free and optional service providing updates about the Zaubersee event and its subsequent editions. It may include information about activities and offers in the region relevant to the event and visitors’ stay, with links to the Lugano Region website. Subscription does not result in inclusion in the general Lugano Region newsletter mailing list.

The mailing list is managed directly by the Ente Turistico del Luganese (ETL) and is separate from the organisation’s other mailing lists. Subscriptions are collected through the Mailchimp form integrated into the Zaubersee website; no contacts are imported from Salesforce or other mailing lists, nor are Zaubersee subscribers transferred to Salesforce.

Subscription requires the expression of consent and subsequent confirmation by email (double opt-in). No newsletters are sent without confirmation. Unsubscription is possible at any time, with all mailings ceasing, by clicking the unsubscribe link included at the bottom of each Newsletter.

Personal Data Processed

The personal data processed for the management of the mailing list and the distribution of the Newsletter are: (i) email address; (ii) IP address and data relating to the subscription and confirmation process, including date and the choices made; (iii) first name and last name; and (iv) language, where such fields are provided in and completed through the form. The form identifies which fields are mandatory and which are optional.

Email Opens and Link Clicks

The tracking of email opens and link clicks for measuring the effectiveness of the Newsletter is carried out only following separate, optional consent distinct from newsletter subscription. This information may be associated with the recipient’s email address. ETL does not use it to segment recipients according to their interests or to personalise content. Refusal or withdrawal of this consent does not prevent receipt of the Newsletter.

Consent for measurement activities may be modified or withdrawn through the methods indicated in the mailings or by writing to privacy@luganoregion.com. ETL does not track the time spent reading emails.

Technical processing activities carried out by the service provider to deliver the service, protect mailings and prevent abuse remain separate. Disabling the statistics available to ETL does not necessarily imply the absence of any technical redirection or anti-abuse processing by Mailchimp.

Mailchimp e trasferimenti all’estero

We manage the Newsletter through Mailchimp, a service provided by The Rocket Science Group LLC, part of the Intuit group, headquartered in Atlanta, United States. For the collection of subscriptions and the management and delivery of the Newsletter, the provider processes data on behalf of ETL in accordance with the Data Processing Addendum (DPA).

Use of the service involves the transfer and storage of data in the United States. The Rocket Science Group LLC is included within the Intuit group’s certification under the Swiss-U.S. Data Privacy Framework. For transfers covered by this certification, Switzerland recognises an adequate level of data protection (Art. 16 para. 1 FADP and Annex 1 DPO).

For transfers subject to the GDPR, participation in the EU-U.S. Data Privacy Framework is also relevant within the scope of that framework. Where a transfer is not covered by an adequacy mechanism and contractual safeguards are required, the DPA incorporates the Standard Contractual Clauses.

Mailchimp may engage sub-processors for the provision of the service in accordance with the DPA; their locations are listed in the provider’s updated sub-processor register. For processing activities carried out by Mailchimp or Intuit for their own purposes, the provider’s privacy notice also applies.

ETL does not sell or provide email addresses to third parties for their own marketing purposes. Data are disclosed only to service providers involved in delivering the service, within the limits described in this notice.

Retention

Subscriber data are retained for the purpose of sending the Newsletter dedicated to Zaubersee and its subsequent editions for as long as the subscription remains active. ETL periodically reviews the need to maintain subscriptions, taking into account the continuation of the event and the frequency of mailings. Should the event no longer be organised, the mailing list will be deleted within 12 months of the last edition. Data that are no longer necessary are deleted or anonymised.

Following unsubscription, mailings cease and data are deleted within 30 days. Only the information necessary to document consent and its withdrawal, manage potential disputes and prevent unwanted re-subscriptions may be retained separately for as long as required for those purposes and will not be used for further promotional mailings. Unconfirmed subscriptions and any individual open and click data are not retained beyond what is necessary respectively for the confirmation procedure and the evaluation of the relevant mailings.

Controller, Rights and Contacts

The data controller is Ente Turistico del Luganese, Via Giovanni Nizzola 2, 6901 Lugano, Switzerland. The processing of personal data in connection with the Newsletter is governed by Swiss data protection law, in particular the Canton of Ticino Data Protection Act (LPDP) and the Swiss Federal Act on Data Protection (FADP), within their respective scopes of application, as well as, where applicable, Regulation (EU) 2016/679 (GDPR).

The legal framework and the rights of the data subject are set out in Zaubersee’s Privacy Policy.
