The following general terms and conditions (as amended as necessary) apply to all services relating to the Zaubersee event made available by Ente Turistico del Luganese online, via any mobile device, by email or by telephone. 

By accessing the website www.zaubersee-lugano.ch and its affiliated websites, visiting it, using it and/or using any of the applications available through any platform (hereinafter referred to as the "website"), you acknowledge that you have read, understood and accepted the terms and conditions set out below. The website is also accessible through the domains zaubersee-lugano.com, lagomagico-lugano.ch e lagomagico-lugano.com.

These pages, their content and structure are owned, managed and offered by Ente Turistico del Luganese, hereinafter referred to as ETL.

The processing of personal data is described in the Zaubersee website Privacy Policy. Browsing the website and accepting these terms do not constitute consent to the processing of personal data for which specific consent is required; such consent is collected separately.

1. Privacy and cookie policy

The website respects privacy in accordance with the regulations provided by Swiss data protection law, in particular the Cantonal Act on the Protection of Personal Data (LPDP) and the Federal Act on Data Protection (FADP), within their respective scopes of application, as well as, where applicable, Regulation (EU) 2016/679 (GDPR). 2. Newsletter policy

The distribution of the Zaubersee newsletter complies with the data protection regulations described in the Privacy Policy. The Newsletter is a free and optional service dedicated to the Zaubersee event and its subsequent editions. Subscription does not result in inclusion in the general Lugano Region newsletter mailing list. We invite you to consult the Zaubersee Newsletter Policy ("Consent to the sending of newsletters and information on the processing of personal data") for further information.

3. Intellectual Property Rights

Unless otherwise specified, the software required to provide the services used by the website and the copyright of the content (including copyright), the information and material on this site are the property of ETL.

ETL exclusively holds all rights, titles and interests of the material and in respect of all intellectual property rights relating to the graphic aspect and the general interface (including infrastructure) of the website through which the service is made available (including guest reviews and translated content). Nobody is authorised to copy, obtain, provide through link, publish, promote, integrate, use, combine, nor in any other way to use the contents of the website (translations and guest reviews included) or the brand in the absence of an express written approval by ETL.

In the case in which a person uses or combines (partly or totally) content (including guest reviews and translations) or in any other way takes possession of any intellectual property right of the site or any content (or translation), it will assign, transfer and dispose entirely such intellectual property rights to ETL.

Any use that does not conform to the law or to any of the actions or behaviours mentioned above constitutes a material breach of intellectual property rights (including rights of copyright and the protection of databases).

4. Various

To the extent permitted by applicable law, these terms and conditions and the provision of services will be governed by and construed in accordance with Swiss law.

In the event that any of the clauses of the present in the page Legal is not valid, loses validity, is or becomes not binding, you will continue to follow all the other clauses laid down herein. In this case ETL will replace the aforementioned clause with a clause that is valid and binding, which has an effect as much as possible similar to the one being replaced and that the visitor / service user will undertake to accept in respect of the content and the aims of the present terms and conditions.
